MEMBERSHIP TERMS AND CONDITIONS

PRINCIPAL TERMS

1.      This agreement commences once you have indicated your acceptance in the Declaration section of the web sign-up process. 

2.      When we notify you that your membership application has been approved, at which point a contract between you and IRON LADIES FITNESS will exist, this agreement will then be enforceable against you and us.

3.      You may not assign this Agreement to any third party.

4.      You will be entitled to all the rights and privileges set for the Type of Membership chosen.

5.      You cannot transfer this agreement to anyone else.

DIRECT DEBIT CHARGES AND FEES

1.      The Joining Fee (if one is payable) and first month's membership fees are collected from you by us either by Debit / Credit card at the time of purchase, or by Direct Debit approximately 5 working days from your membership application date. Joining fees are applied to cover the initial administration costs associated with setting up a new membership and direct debit agreement and entitle the member to an induction session, bookable online.

2.      If you are looking to upgrade your membership there may be an admin fee charged at the point at which you upgrade.

3.      Your second Direct Debit for monthly membership fees only will be collected one month after you joined, unless you joined before your gym opening in which case they will be collected one month after the gym opened. Subsequent Direct Debits for monthly membership fees will be collected monthly thereafter. Each payment made is not refundable under any circumstances.

4.      If any Direct Debit is returned unpaid or if any other form of payment is not honoured for whatever reason, you shall pay us on demand an administration fee of £10. If, despite us having notified you of a missed payment, further payments are missed, we reserve the right to, at our sole election, either suspend or terminate your membership, upon having given you written notice of our intention to do so. We may present an option to reduce the administration fee if the outstanding amount is paid online within 7 days of becoming due.

5.      You agree to advise us immediately of any change to the Members Details provided.

6.      You will not be allowed any access to the gym until your membership payment is up to date.

STUDENT MEMBERSHIP

1.  All student memberships are subject to IRON LADIES FITNESS membership rules and terms and conditions

2.  Student Identification will need to be verified by IRON LADIES FITNESS.

DIRECT DEBIT PRICES

1.      We could occasionally need to raise the membership fee. Any impending price increases will be communicated to you in full, including the date of implementation and the new cost of your membership. You will also receive at least one full month's notice of any such increases. You will be able to cancel your membership at any time during this time by following the terms, conditions, and regulations of the membership. The cost of your membership will increase following our notification if you do not cancel by the date specified in the notice.

TERMINATION OF MEMBERSHIP

        2.    Members may cancel their membership by providing written notice according to the terms stated in the membership                                  agreement by giving 1 month’s notice. 

3.     Refunds, if applicable, will be processed according to the cancellation policy. Refunds will not be given if members fail to cancel their membership and do not give the required notice.  

4.     Pay-as-you-go session refunds will NOT be credited to your account unless a minimum of 24 hour’s notice is given. 

5.  Refunds will not be given. 

KEY CODE ABUSE POLICY 

1.      You are the only one who can use your PIN number: Since your membership is specific to you and only covers your use of IRON LADIES FITNESS, your PIN number has been issued only for your use. It is your responsibility to maintain the confidentiality of your PIN number at all times. At all times, the PIN number is our property unless otherwise specified in writing.

2.      Use of PINs is monitored: To ensure the safety and security of each and every one of our members, PIN usage and access are tracked, and those who use them may be required to present identification.

3.      In the event that we believe your PIN has been abused, we will: If there is any reason to suspect that another person or people have used your PIN, we reserve the right to launch an inquiry. If this happens, we'll do the following: (a) send you an email stating that we think someone else may have been using your PIN, and we ask that you help us with our reasonable investigation. (b) after our investigation is complete, we'll send you an email with our findings and our suggested course of action, which might involve taking any number of the actions outlined in paragraph below.

4.      Our Right to impose extra fees and/or terminate your membership: We reserve the right to take one or both of the following actions, in addition to any other legal rights we may have, if you unreasonably refuse to cooperate with our investigation, or if, after our investigation, we have reasonable grounds to believe that your PIN number was used, with or without your knowledge and/or consent, by another individual or individuals. The specifics of each case will determine which action we take. (a) to increase your direct debit payment(s) in accordance with the penalty charge that will be applied to your membership fees.

DAILY MEMBERSHIP TERMS & CONDITIONS

PRINCIPAL TERMS 

1.      As soon as you confirm your approval in the Declaration phase of this online sign-up process, your daily membership will begin.

2.      On the day you designate, your membership will become active and remain active until midnight on that same date.

3.      All of the rights and benefits that are applicable to the membership type you have selected will be granted to you.

4.      This daily membership cannot be transferred to another person or to a different day.
There are no refunds for day passes.

DAY PASSES

1.      There is a fair use policy in place for day passes. Per individual, one pass; multiple passes subject to sudden cancellation.

2.      Free passes cannot be redeemed for cash or any other good or service, and they have no market value.

3.      Passes have to be used consecutively every day.

4.      It is best to schedule free passes such that they begin before the stated expiration date. After this date, any passes scheduled for redemption could be cancelled without prior notice.

5.      As soon as you confirm your approval in the Declaration phase of this online sign-up process, your daily membership will begin.

GENERAL TERMS AND CONDITIONS 

1.      Members must be at least 12 years old to use the gym with an adult Once they turn 16 they may come without an adult.

2.      You consent to abide by the Club's Rules of Membership, which are posted and cover matters such as conduct, facility use, and opening and closing times.

3.      We may reasonably amend these Rules at any moment as long as we notify you in advance of the change.

4.      We may nevertheless strictly enforce the terms of this agreement at a later time even if we do nothing, forgive you for any violations, or give you more time to pay or comply.

5.      With your notice, we may transfer the benefit of this agreement and our rights under it to a third party. Nothing in this agreement will affect your rights.

6.      We might occasionally need to close all or a Portion of the gym and amend the class timetable. If a closure is necessary, we will try to notify you in advance of the planned closure, unless there is an urgent issue. We shall make every effort that is reasonably possible to guarantee that these closures occur outside of the busiest times for visitors and are as brief as possible in terms of both frequency and duration. In such cases, you will not be eligible for a partial or complete return of your membership costs.

7.      If an occurrence beyond our reasonable control results in a failure to perform, or a delay in the performance of any of our responsibilities under these conditions, we shall not be accountable or responsible.

8.      You have legal rights as a customer if any services are rendered without using reasonable skill and care, or if the materials we use are defective or misrepresented. You can get information about your legal rights from the Trading Standards or Citizens' Advice Bureau in your community. These legal rights are unaffected by these terms.

9.      The law of England governs this agreement.

10.   If you violate any of the club's rules, we may immediately terminate this agreement and notify you of the situation.

11.   To the best of your knowledge and belief, you are in good health, you are not aware that you are unable to exercise, either actively or passively, and you don't believe that exercising would negatively impact your physical condition, safety, comfort, or overall welfare. Additionally, that in the event that your circumstances change, you will notify us right away.
